Fair point, but I still don't think that is the intention of 8.3.1 which I read as being about the different levels of cover and not about the differing level of vulnerability of the targets.

I think you could read 8.3.1 either way really, it's not super-specific. And TBH it's not a situation that comes up a whole lot.
