Hesitant Battalions fire when being Charged.

Hi Team.
So here is the situation:
A Spanish Malitia Battalion is part of s hesitant Brigade.
It is being charged by a Regiment of French Hussars approaching from the Spaniard's left flank.
Two nearby Spanish squares fire at the passing Hussars as they close to within 6inches of the Targetted Spanish Militia Battalion.
When the Hussars reach the 6 inch point they are outside the frontal arc of the targeted Spanish Militia.
The Spanish Militia fail the DT with a modified result '6'!
I believe they Militia can't fire a volley 'inferior' or not because the Hussars are outside the frontal arc and the Militia are part of a 'Hesitant' Brigade..
I'm I correct?

Yes that's correct Scott. Since it is part of a Hesitant Brigade its firing arc is restricted to directly forward.
You assess it when the attackers are 3" away not 6" though. Don't know if that would make any difference.
